These Terms of Service (“Terms”) govern your access to and use of the Accessly platform (“Service”) operated by Accessly (“we”, “us”, or “our”). By creating an account or using the Service you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
1. Acceptance of Terms
By accessing or using Accessly you confirm that you are at least 16 years of age, that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, you must not use the Service.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the Service. Continued use after the effective date of updated Terms constitutes acceptance.
2. Description of Service
Accessly is a web accessibility scanning platform that enables users to:
- Scan public URLs for WCAG 2.2 accessibility violations using automated testing
- Upload PDF and Word documents for accessibility checks
- Monitor saved websites and track compliance over time
- View detailed reports and remediation guidance
- Access scan history and compliance trends via a dashboard
- Access the platform programmatically via our REST API (paid plans)
Accessly’s automated scanning identifies a subset of accessibility issues. It does not guarantee full WCAG compliance and is not a substitute for manual expert review.

6. Acceptable Use
You agree not to use Accessly to:
- Scan URLs or upload documents without authorisation from the content owner
- Attempt to circumvent rate limits, scan limits, or other service restrictions
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use the Service to transmit malware, spam, or any harmful content
- Resell, sublicense, or commercially redistribute the Service without our written consent
- Interfere with or disrupt the integrity or performance of the Service or its infrastructure
- Use the API in a manner that exceeds reasonable usage or places undue burden on our systems
- Violate any applicable law or regulation
We reserve the right to suspend or terminate accounts that violate these requirements without prior notice.

8. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Accessibility scan results are produced by automated tools and may not identify all accessibility issues. Accessly does not guarantee that following our recommendations will achieve full legal compliance.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ACCESSLY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions our liability is limited to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Accessly and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- Your use of or inability to use the Service
- Your violation of these Terms
- Your violation of any third-party right, including intellectual property or privacy rights
- Any content you submit to the Service

12. Governing Law and Disputes
These Terms are governed by and construed in accordance with applicable law. Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved informally by contacting us at contact@accessly.us.
If informal resolution fails, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction, as required by applicable law in your location. You waive any right to participate in a class-action lawsuit or class-wide arbitration.
